As in any crucial venture, good organization is necessary for a successful divorce. We’d like to think that the financial goals of a divorce should be easy. Divorce can be achieved through several processes. As mediators our focus is on mediation, especially if you and your spouse agree about the major issues. Mediation offers an easier, much less contentious process. It only works if both parties agree on most of the issues and want a fair outcome for their self and family. Collaboration, another way to divorce, means working with attorneys to negotiate a settlement out of court that is agreeable to both spouses. Litigation is often more contentious. Your attorney will serve your spouse divorce papers and you will need to go to court to settle the issues. The last two processes involve more time and effort, and don’t always end the way the spouses expect.

The preparation for mediation is much like other types of divorce. But, in our experience, Mediation has higher compliance rates than with litigated settlements. To get started, spouses will need to inventory their assets and debts with necessary documentation. A history of your tax filing is important. Know the costs of running your household, develop a post-separation agreement, and if you currently have a joint bank account, be sure to open one of your own.

Mediation is often the best way to achieve a successful resolution. It is less expensive, less time consuming, and if both spouses are willing to compromise, mediation produces a positive outcome for the end of a marriage.
